¿Qué es la devolución de saldo a favor de IVA?
Si bien, contribuir a los gastos públicos es una obligación constitucional, también las personas físicas y morales están en su derecho de obtener devolución de saldo a favor IVA.
Mediante este derecho, los contribuyentes tienen la oportunidad de recuperar las cantidades que hayan pagado indebidamente al Servicio de Administración Tributaria (SAT), así su saldo a favor IVA.
Para la realización de estos trámites se debe estar en cumplimiento con lo previsto en las disposiciones fiscales.
Requisitos para devolución de IVA en México.
Para solicitarla devolución del IVA al SAT, primeramente, el contribuyente deberá cumplir con la regla 2.3.4 de la Resolución Miscelánea Fiscal 2022.
Así, pues, se comienza el trámite mediante el cumplimiento de los siguientes requisitos de devolución e IVA.
- Contar con datos de la declaración normal y/o complementaria de impuestos federales con datos como lo es el número de operación, fecha de presentación y monto de saldo a favor.
- Adjuntar trámite de anexo 7 y 7-A.
- Presentar estado de cuenta que no exceda más de 2 meses.
Del mismo modo, la autoridad puede solicitarte información adicional de existir alguna inconsistencia en tu solicitud de devolución de IVA, como:
- Documentación que acredite la materialidad de operaciones.
- Escritos libres –bajo protesta de verdad- que exprese el origen de los recursos.
- Papeles de trabajo que integren las operaciones con proveedores y clientes.

- ¿Cuánto tiempo tarda la devolución del IVA en México?
Una vez que se solicita la devolución de IVA, esta debe efectuarse en un plazo de 40 días hábiles siguientes. Para ello se debe haber cumplido con los requisitos correspondientes para el caso de depósito de cuenta.
- ¿Dónde puedo realizar mi trámite de devolución de saldo a favor IVA?
La solicitud de devolución de IVA puede efectuarse de manera presencial, apoyado por el la Administración local de servicios al contribuyente.
Asimismo, puede efectuarse la devolución de IVA por internet, realizando el trámite mediante el portal de internet SAT, siguiendo los pasos que te muestra.
- ¿Qué pasa si mi trámite para recuperar el IVA en México es denegado?
Si tu trámite ha sido denegado, seguramente te saltaste alguno de los requisitos de devolución de IVA o la autoridad detectó alguna discrepancia. Para ello, el SAT te solicitará información adicional, misma que deberás entregar en un plazo de 20 días hábiles.
